Maryland has zero pending HOA bills, and the next ones get written before anyone votes in November

What happened. As of today there is not a single live HOA, condominium or cooperative bill anywhere in the Maryland General Assembly. Not pending, not carried over, not pre-filed. The board is empty, and it will stay empty until late autumn.
Three things had to be true for that, and all three are:
- Maryland bills do not carry over. Every measure from the 2026 Regular Session died at sine die on 13 April 2026. That includes the nine community-association bills that passed the House of Delegates and the roughly twenty that died in committee.
- The August special session was closed. The 450th session, 3–5 August 2026, was limited by the presiding officers to a constitutional amendment on congressional redistricting, with drafting and staff resources dedicated solely to that — a decision that drew Republican objection. Non-redistricting bills were not considered.1
- No 2027 bills exist. The legislature's system serves no 2027 session data. Queries for the first House and Senate bill numbers of a 2027 session return “Bill number does not exist.”2
No community-association bill was vetoed in 2026, so none was before the special session. Of the Governor's five 2026 vetoes, two were overridden — on divorce records under the Public Information Act and on freight-train crew requirements — and three were sustained. Neither override touches this sector.3
The calendar that actually governs the next six months
These are the dates from the Department of Legislative Services' own interim publication, and they are the only fixed points between now and January:4
- 3 November 2026 — general election.
- 20 November 2026 — statutory deadline for members to request drafting of pre-filed bills.
- 1 December 2026 — the housing department's report on condominium buildings over 40 years old is due to the General Assembly under Chapter 779.
- 10 December 2026 — statutory deadline for members to approve drafted bills for pre-file introduction.
- December, date to be announced — the compilation of legislative committee interim reports goes to the Legislative Policy Committee.
- 13 January 2027 — the 2027 Regular Session convenes; it adjourns 12 April 2027.
Look at the order of those. Drafting requests are due 20 November and the condominium reserve-shortfall report is due 1 December. A legislator who wants a reserve or inspection bill built on the State's own findings has to commission the draft ten days before the findings exist.
That is not a small procedural quirk. Chapter 779's study is the only hard data Maryland will ever have produced on the reserve gap in its older condominium stock, and the session best placed to act on it is structurally unable to have read it first. A responsive bill would have to be introduced during session rather than pre-filed — and a bill introduced late in a Maryland session goes to the Rules Committee, which is where SB 955 and SB 981 died this year without hearings.
2027 is a reset, not a continuation
The 2027 session is the 451st General Assembly session and the first of a new four-year term, following the November election. Maryland's primary was held on 23 June 2026.5
So the 2026 dynamic repeats only if the same people occupy the same positions. The chairs who determined this year's outcomes, as of the April 2026 roster:
- House Economic Matters — Kriselda Valderrama. Where the owners' bill of rights, manager licensing, the election-law fix, reserve-study exemptions, the common-area alteration vote and the online-resale-disclosure bill all died without a report.
- Senate Judicial Proceedings — William C. Smith, Jr. Where five House-passed community-association bills received hearings and no votes.
- House Environment and Transportation — Marc Korman.
- Senate Education, Energy and the Environment — Brian Feldman.
The Speaker of the House is Joseline A. Peña-Melnyk and the Senate President Bill Ferguson. One structural change already happened: the House Health and Government Operations Committee was split into separate Health and Government, Labor, and Elections committees — the latter being where the 2026 sign-display act and the Baltimore County nuisance bill originated.
What is actually happening, with nothing pending
Five dates matter more than any bill right now, and four of them arrive before the session does:
- 1 October 2026. Every Maryland county and municipality must have adopted a local law permitting accessory dwelling units on single-family lots. Board-installed EV charging protection takes effect. Charles County board-member training takes effect.
- 1 December 2026. The Chapter 779 report.
- 4 January 2027. The GSE reserve minimum for a Full Review rises from 10 to 15 percent of budgeted assessment income, unless the association has a reserve study from the last three years funded at the highest recommended level — against Maryland's statutory five-year cycle.
- 1 October 2027. Chapter 717's insurance regime: unit-owner responsibility to $25,000 and mandatory unit-owner coverage.
Plus one thing with no date at all: the Attorney General's Consumer Protection Division has held express authority to adopt regulations under both the Condominium Act and the HOA Act since 1 October 2025, and has not used it. A regulation under that authority would bind every Maryland association without a bill, a floor vote or a session — through the Maryland Register proposal-and-comment process instead.
Which is the honest answer to “what is pending in Maryland?” Legislatively, nothing. Administratively, an unused rulemaking power. Judicially, an undecided circuit-court case over the removal of three elected directors at the state's largest association.
What to watch next
The pre-file list, in late November and December. Which of the nine House-passed bills reappear — and in which chamber — is the most informative signal available before January.
One specific thing to look for: a Senate-side pre-file. Six community-association bills went to Senate Judicial Proceedings in 2026 and none emerged; the two Senate bills that became law moved in their own chamber first, in mid-March. A sponsor who has read that record and pre-files in the Senate is signalling a change of strategy. A sponsor who refiles in the House in February is signalling a repeat.
